Scott Nightingale is an experienced insurance lawyer, having practised exclusively in the insurance sector for the past 20 years, providing dispute resolution and claims solutions for clients on a wide range of insurance related issues. He has considerable experience advising and representing policyholders (both corporates and private individuals) in respect of claims involving property damage, professional indemnity, product, and general liability.
Scott has a particular interest and expertise in cyber and data privacy law, having previously practiced as breach response counsel advising on cyber related incidents, GDPR breach and data privacy related claims. His cyber practice now focusses on advising on coverage issues arising under cyber insurance policies and offering advisory and gap analysis services for existing and prospective policyholders to ensure they are appropriately insured against cyber and data risk.
Scott is passionate about helping policyholders achieved the desired outcome providing commercial, pragmatic and practical advice.
Client matter highlights
Property & Business Interruption
- Successfully represented a client in a dispute with a home insurer following a significant flood event, where the policy was initially avoided for alleged non-disclosure and/or misrepresentations.
- Advised and successfully representing a property management company in a multiparty and multifaceted dispute following a significant fire event in London where the policyholder was defending, through no fault of its own, an allegation that a proposal form prepared and submitted by its professional agents contained reckless misrepresentations.
- Successfully represented a number of private individuals in pursuit of business interruption losses following Covid-19 against an insurer in a dispute about the policy indemnity period.
- Advised and successfully represented numerous policyholders in their complaints to the Financial Ombudsman on a range of property insurance related matters.
Professional Indemnity
- Advising and representing a property management company in its claim against its professional advisers following alleged reckless misrepresentations made when placing insurance cover.
- Advising an SME client following a significant theft at its warehouse in relation to a claim against its insurance broker.
Cyber/Data Risk Advisory
- Carried out insurance gap analysis advisory work (with an emphasis on cyber and data risk) for a large charitable organisation identifying gaps and areas of risk in their insurance portfolio.
- Advised on the scope of a proposed cyber policy for a UK University with international reach.
Other Risks
- Representing a business in the defence of multiple employers’ liability claims whilst at the same time challenging an insurer’s decision to avoid numerous insurance policies for non-disclosure and misrepresentations.
